What is the true penalty of taking non-prescribed vicodin while abroad in Iraq?

I am extremely interested in figuring this information. A brother in-law of mine stated that he was sent domestic early for having and consuming non-prescribed Vicodin while on active duty in Iraq. I'm sorry, but if he was in the states, he would possibly have jail time... so I think there is something that he is not saying. Can anyone please give me a professional reply/opinion based on the information that I have given to you. Thanks and look forward to your feedback! )

Taking unprescribed medication, such as Vicodin, is the same object as buying Coke from a dealer. It's a Major infraction and he will be discharged from the military.

No, jail time is Very unlikely unless he was selling the stuff to other personnel. They'll simply want to rid themselves of him quickly.

It is likely that the military will simply kick him out of the service with an Oth (other than Honorable) discharge.

The man is a loser and the military is simply not going to waste their time with him.

they may apply article 15 on you, drop all your rank to e1, and worst job available, scrub latrines. But not know or sure, I guess you should try and come back to tell us what.

The Uniform Code of Military justice is the only legal system that has jurisdiction over U.S. forces in Iraq and Afghanistan. The Ucmj does not have mandatory sentences for various charges like U.S. Code does. They can throw the book at you or they can be relatively lenient. It's possible your brother in law got charged under Ucmj and kicked out. Don't think he got off light though. Chances are decent he did some disagreeable Extra Duty time, possibly some time in confinement, and got an Other Than Honorable discharge, which is a black mark that will follow him the rest of his life. Many people will not hire someone with that.
