A recently arrested friend was charged with the wrong penalty group...?

A friend recently was arrested arrested during a routine traffic stop for anabolic steroids. He was charged him with the offense of possession of controlled substance penalty group 2 But steroids are classified in penalty group 3. Do this intend anything that they charged him with the wrong penalty group?

And how is it a felony when it is classified as a group 3?

Yes, it's possible the case may have to be thrown out due to the misinformation. I don't think it's a enormous offense, so I'd wait before getting a lawyer and see how it goes.

If he goes to trial, either the prosecution or the defense lawyer will pick up on the error. It will not cause the case to be dismissed. They will just amend the charging document.
